Booking Terms

These booking terms (‘Booking Terms’) are between eviivo limited with offices at 154 Pentonville Road, London, N1 9JE, UK (Registered in the UK under 5002392) our officers, employees and agents (‘eviivo/We/Us/Our’) and the person or legal entity making the Booking (‘You/Your’) on the Accommodation’s reservation site (‘Website’) operated by eviivo.

These Booking Terms cover the provision of accommodation services (‘Booking(s)’), by the hotel, guesthouse or accommodation provider You have selected (the ‘Accommodation’) as displayed online at the time of booking and in the confirmation sent to You by email (the ‘Booking Confirmation’). These Booking Terms are governed by the laws of England and Wales and apply to all Bookings.

By making a Booking You accept to be bound by these Booking Terms and confirm that You are able to enter into a legally binding contract, and that You are over 18 years of age.

Bookings

Our services to You are to take your Booking and Your payment (where applicable) and to make the necessary arrangements with the Accommodation You selected. We are not in a position to ensure that the Accommodation meets your expectations or performs its services properly or at all. When eviivo manage your online booking, We are acting on the Accommodation’s behalf and We are not in a position to modify the Accommodation’s policies. eviivo do not represent or hold themselves as a Travel Agency, and nothing in this Agreement shall be construed, or deemed to be construed, as an agency agreement between You and eviivo.

Our liability is limited to securing the Booking, making sure accommodation is made available to you at the required dates, collecting any required payment, and managing any refund in the event of a cancellation, in line with the terms of the Cancellation Policy and Payment Terms set out in your Booking Confirmation which you accepted by ticking the box provided at the time of booking.

Bookings are made and a contract between You and eviivo comes into effect when We accept a reservation from You. A reservation is deemed accepted when We have confirmed Your reservation and received either: (i) a full payment of the total price; or (ii) the payment of any other deposit amount specified at the time of booking and as stipulated in Your Booking Confirmation or (iii) a valid payment card successfully pre-authorised for an amount that is no less than the value of the cancellation fee stipulated in Your Booking Confirmation.

Notwithstanding Your rights under the Cancellation Policy, You do not have the right to withdraw from this Contract.

Where a payment collected from You is less than the total value of the stay, the balance will either be collected from You prior to arrival on the date(s) stipulated in Your Booking Confirmation, or paid by You directly to the Accommodation, on either check-in or check-out, or, if so agreed, by direct communication between You and the Accommodation.

When Your Booking is confirmed, a reservation number is issued and displayed in Your Booking Confirmation. This number must be retained and quoted in all communications with the Accommodation or with Us, should any cancellation or amendment be necessary.

Although You make a Booking through Us and have a contract with Us, the Accommodation is responsible for the day-to-day provision of the services to You under that Booking. Therefore, all and any complaints must be directed to the Accommodation in the first instance.

Group bookings of four or more rooms will be charged at 50% payment on booking with the remaining balance due 14 days before the first night of the stay.

Prices

Prices quoted are correct (unless a Pricing Error occurs) only for the specific number of guests, dates, nights and rooms shown in Your Booking Confirmation.

The total reservation price is expressed in the currency indicated quoted in your Booking Confirmation and includes the taxes applicable at the time of booking, at the current rate, including without limitation sales taxes, value added taxes or local taxes, which may be itemized separately. Taxes may change subject to changes in the applicable regulation (provided that such changes were not in the public domain at the time of booking).

If You have selected booking extras, where applicable the cost of these extras and applicable taxes may also be added to the reservation total for Your Booking.

The total reservation price does not include other costs for goods, services or taxes that You may choose to incur later during Your stay (unless otherwise stated).

Pricing Error

On the rare occasion that a Pricing Error occurs and the Accommodation does not accept Your reservation, even after We have issued a Booking Confirmation, We will notify You as soon as We reasonably can and refund the amount paid by You in full without any liability for this error or omission. You agree that neither We nor the Accommodation will be liable for any additional expenses You may incur as a result of the error or omission.

Availability

In the rare case that the Accommodation is unable to accommodate Your Booking, You will be offered alternative accommodation by the Accommodation and if there is a difference in the Price, the Accommodation will be liable for the price differential. If the differential is less than the original value of Your Booking a refund of the difference will be made to You. If the differential is more than the original value of Your Booking the differential cost will be borne by the Accommodation.

Arrival and departure

The latest arrival (check-in) and departure (check-out) times are specified on Your Booking Confirmation. Should You wish to check-in later than the latest check-in time You must confirm this directly with the Accommodation. In the event that You attempt to check-in later than the stated times without prior arrangement, or fail to check-in at all, the Accommodation may cancel Your Booking and retain any amounts it is entitled to retain as stated in the Cancellation Policy section of Your Booking Confirmation. Failing to arrive on or before the latest check-in time shall be deemed to be a full cancellation of Your Booking, and the accommodation may no longer be held for You.

Cancellations and Amendments

You may cancel Your Booking yourself by using the link provided in your Booking Confirmation email. Should you wish to modify the terms of Your Booking, you are required to discuss any other Booking amendment with the Accommodation directly. If You change the number of guests, dates, room nights or room type (‘Amendment’), then the prices are subject to
change.

Cancellation terms are displayed on the Site at the time of booking, specified on your online confirmation, and set out under the Cancellation Policy section of the Booking Confirmation sent to You by email.

If Your Cancellation occurs before the cancellation deadline specified on Your Booking Confirmation (‘Cancellation Deadline’), any amount prepaid towards the Reservation, including extra goods or services, shall be reimbursed to You at no cost.

If Your Cancellation or Amendment occurs after the Cancellation Deadline specified on Your Booking Confirmation, the Accommodation has the right to cancel your entire Booking and charge any applicable cancellation fees and the Accommodation is under no obligation to hold the accommodation for You.

Should You request an Amendment and should the Accommodation not be in a position to accommodate Your Amendment, Your Booking will be cancelled and a full refund given to You provided that such cancellation or amendment occurs on or before the Cancellation Deadline, failing which the terms described in this Cancellation clause shall apply.

IMPORTANT: if Your Cancellation occurs after the Cancellation Deadline specified on Your Booking Confirmation, eviivo cannot waive or refund the applicable cancellation fees unless this is confirmed electronically by the Accommodation you have booked within their eviivo Booking System.

Payments

Bookings must be guaranteed using a valid payment card or via another payment method offered at the time of booking.

Any payment taken via Our eviivo Booking Service will appear on Your card statement under the title ‘Hotel paid via eviivo’; and display eviivo Limited as the merchant of record eviivo collects payments and processes refunds on behalf of the Accommodation and any payment made to eviivo will discharge any amount owing to the Accommodation in respect of Your Booking.

IMPORTANT: your card details are processed according to the PCI-DSS security standard and may be used to charge or pre-authorise any applicable deposit or late cancellation fee that may arise, at any time before check-in, up to the reservation total and in accordance with the payment schedule set out in Your Booking Confirmation. A pre-authorisation is not a charge and no monies are taken from Your account but Your Bank may choose to temporarily reduce the credit limit available on Your card by the pre-authorised amount – this is between You and Your Bank.

Any amount or deposit due and payable at the time of booking, as set out in Your Booking Confirmation, will be charged to Your card or via another payment method offered online, when you make Your Booking.

Any amount(s) or deposit(s) due and payable at a later date but prior to check-in, as set out in Your Booking Confirmation, may be charged to Your card or via the payment method You selected online, according to the schedule set out in Your Booking Confirmation.

The Accommodation will charge You directly at check-in or at check-out for any outstanding amount not collected prior to arrival, up to the reservation total displayed in Your Booking Confirmation. Any additional goods and services purchased during Your stay must also be paid in full directly to the Accommodation.

Your Booking may be cancelled automatically if your card is declined by your bank, or if there are insufficient funds on Your account.

Our liability

Our services to You are to facilitate your Booking and take Your payment (where applicable) in order to make the necessary arrangements with the Accommodation You selected. Our liability is limited to securing Your Booking, making sure accommodation is made available to you at the required dates, collecting any required payment, and managing any refund in the event of a cancellation.
Other than for death or personal injury caused by Our negligence or fraudulent misrepresentation, Our total liability to You is limited to the total price of the Booking and in no circumstances shall We be responsible for any indirect or special damages

We will not be liable to You where We have exercised reasonable care and skill in our provision of the platform and the placement of Your requirements on the Accommodation’s delivery of services to You. We will not be liable for failure to perform to the extent that the failure is caused by any factors beyond Our reasonable control, including the provision of accommodation services by the Accommodation or any malfunction such as without limitations cases of Force Majeure, cyber-attacks, email failures linked to your email provider or your spam and firewall configuration, or third-party fraud.

Accommodation liability

The Accommodation is solely responsible for the delivery of accommodation services to You. Any information published on the Site is supplied ‘as is’ by the Accommodation directly, including its location, photos, descriptions or accreditation ratings et We have no control over the accuracy or reliability of such information.

Although We take care in Our selection of Accommodations and try to cater for different tastes and budgets, We do not have any control over the Accommodation, nor do we carry out any form of inspection of these Accommodations, and therefore we are not responsible for what they do, or do not do.

Should You have any concerns relating to the Accommodation’s operation, hygiene, health and safety practices or services, or if You would like to check the specific conditions of stay relating to the Accommodation, You should address these with the Accommodation directly, or contact the relevant regulatory authority. We also recommend that You take out the appropriate travel insurance.

Your liability

You are responsible for any damage or loss caused by You to the Accommodation, including any damage to their property by Your act, omission, default or neglect and You agree to indemnify the Accommodation, and You agree to pay the Accommodation, on demand either directly or via ourselves, the amount reasonably required to make good or remedy any such damage or loss.

Further, We reserve the right to terminate Your Booking immediately without being liable for any refund or compensation where You engage in unacceptable behaviour that causes a disturbance or nuisance to other guests at the Accommodation.

Data protection

We may process the information You provide to Us when You make Your Booking for the sole purposes of completing our duties under this Agreement and as notified by Us to the relevant Information Authorities.

The collection of Personal Data related in particular to Your identity, domicile, personal status, phone number, email address, bank card and bank account numbers, or to the transactions you enter into or the payments you make, is a mandatory requirement for the completion of your Booking and the processing of any payment. Without this personal data your transaction could be delayed or rendered impossible and your reservation could be cancelled.

Your personal Data will be processed by eviivo including any of our majority owned affiliates and our service centre in Tunisia, and it will also be transferred to the Accommodation You have selected and to any third parties who operate the Accommodation’s Website, as such data transfers are necessary for the successful completion of Your Booking. Your personal data will also be processed by Our Merchant Bank Ingenico Financial Solutions SA/NV, for the sole purpose of being able to process your payment. The processing of Your payment includes fraud monitoring and fraud management and other checks related to the fight against money laundering and the financing of terrorism. While eviivo have been given assurances that the above third parties operate in conformance with the Global Data Protection Regulations, eviivo cannot accept any responsibility whatsoever for how the above parties may use your personal data. If you have any concerns you should address them to these third parties directly, or to the Accommodation, using the contact details provided in your Booking Confirmation.

We may also be required to communicate certain information or documents to the competent financial, judicial, administrative, law enforcement or legal authorities, where they have made such a request or to the extent necessary or required under applicable law and regulations.

By making a Booking, You consent to the processing of information as described in this clause and to the transfer of Your information to the Accommodation you selected and to any third party operating the Site where Your booking originated. You have the right to request that eviivo delete or return your personal data (in such format as reasonably determined by eviivo) after the end of the provision of the Services, unless applicable law requires otherwise. eviivo limited (registered office 154 Pentonville Road, London, N1 9JE company number: 05002392) (“eviivo”) operate the Booking Service we use to manage all online bookings for The Old Hall Bed & Breakfast (the ‘Accommodation’.

In taking your online reservation, eviivo is acting on behalf of your chosen Accommodation exclusively. eviivo are liable only to the extent outlined in the Booking Terms set out below as accepted by you at the time of booking. eviivo’s liability is therefore limited to the full or partial value of the reservation it has collected from you for this booking, and its refund in the event of a cancellation, subject to the terms of the above cancellation policy and payment terms.
eviivo are not in a position to ensure that our Accommodation meets your expectations or performs its services and eviivo make no representations whatsoever as to the suitability of the selected Accommodation. You are advised to contact the Accommodation directly if you have any further query, or to take out appropriate travel insurance.
In no event will eviivo be liable to you for any lost profits or any indirect, consequential, special, incidental or punitive damages arising out of, based on or resulting from your booking or your stay even if eviivo have been advised of the possibility of such damages. These limitations and exclusions apply without regard to whether the damages arise from breach of contract, negligence or any other cause or action.

Christmas and New Years Parties Terms and Conditions

How to Book

  1. Allocate a Group Leader and dedicate this person to be group organiser for the booking process.
  2. To provisionally hold your places for 10 days and to check availability, please email events@theoldhallely.co.uk
  3. To confirm your places, we will send your group organiser a booking form and then send it back to us, together with a booking and administration fee of £30 per person for your whole party.
  4. On receipt of this booking form and booking and administration fee, your booking will be confirmed and a confirmation invoice sent to you.
  5. Final payment, a balance invoice will be sent out approx. 10 weeks prior to your party date. The balance must be received in full by 1st October 2022.
  6. Bookings made after 1st October 2022 will require full payment at the booking stage.
  7. Menu and Drinks pre order forms will be sent out upon confirmation of your booking and administration fee and must be sent back via email 4 weeks before your date.
  8. We regret we are unable to guarantee any special dietary requirements received in writing less than 2 weeks prior to the event.
  9. Drinks vouchers will be available to collect from the entrance by your group leader upon arrival. Vouchers are on a pre-order basis only and cannot be bought on the day.

Menu Pre-Orders

  • There is a choice menu for each event, with a vegetarian alternative and special dietary menus available on request. Menu choices must be received no later than 4 weeks prior to your party date.
  • The Old Hall will endeavour to accommodate late menu or detail changes but will not be held responsible for changes communicated in writing less than 2 weeks before the event date.
  • If menu options are not made before the event, the standard Christmas menu will be served.
  • The Old Hall reserve the right to make changes to the advertised menu in the event of shortages in the supply of particular items, but undertakes that a three course meal will be served.

Table Plans

  • Due to on-going changes in configurations, tables will not be allocated until the day of each event. (Mixed and New Year’s Eve parties only)
  • Please fill out the food sheet provided for your guests 1-10 in the order that they would like to be sat around the table.
  • Name place cards will be on the table as per the order of your guests on the menu pre-order form, these cannot be moved on the day.
  • Subject to Covid 19 restrictions and social distancing, table plans may need to be adapted.
  • Terms and Conditions
  • Bookings can only be accepted on receipt of a completed booking form and non-refundable booking and administration fee of £30 per person.
  • We recommend that you make a provisional booking via email prior to sending your booking form, to avoid disappointment if the date and spaces are not available. A provisional booking will be held for 10 days by which time the booking form and booking and administration fee must be received.
  • Should the booking form and payment not be received within 10 days, the booking will automatically be released.
  • We cannot guarantee to make major changes or additions to your party within 2 weeks of your date.
  • We regret that we are unable to make any changes to your booking, menu choice or wine order within 2 weeks of your event.

Refunds and Cancellations

  • Non-refundable booking and administration fee (£30 per person) must be made in order to confirm your booking and can only be accepted from the party organiser.
  • Non-refundable booking and administration fee cannot be converted to pay the balance of other guests or put toward drinks and drinks vouchers
  • Cancellations can only be made by the party organiser and must be made in writing to The Old Hall. We cannot accept cancellations over the telephone.
  • Tables must not reduce below 10 people per table for Christmas Party Mixed Nights.
  • All payments received after 1st October 2022 are non-refundable.
  • Full payment for bedrooms will be required upon booking. Our exclusive parties require all bedrooms to be taken.
  • Subject to Covid 19 restrictions and social distancing The Old Hall has the right to cancel your booking.

Miscellaneous

  • Prices shown on the website include VAT.
  • The Old Hall reserves the right to refuse admission and to remove from the function any person, whose condition in the opinion of the staff of The Old Hall, interferes, or is likely to interfere with, the enjoyment of the function by other participants.
  • The Old Hall does not accept any responsibility in respect of any person prevented from entering the function, or asked to leave due to their conduct.
  • The Old Hall will take every care to honour commitments, but reserves the right to amend or alter all or part of the programme The Old Hall regret that they will not accept liability for errors, omissions or cancellations.
  • The Old Hall does not accept any liability and shall not be liable for non-completion of the event or any delays arising as a result of: – Strikes, Riots or Lockouts affecting any Trade with which The Old Hall is concerned. Adverse weather conditions, loss, damage or cancellation due to Fire, Flood or any other cause beyond its control.
  • These Terms and Conditions are governed by English Law and in the unlikely event of a dispute, the parties shall submit to the exclusive jurisdiction of the English Courts. The liability of The Old Hall in respect of any breach of these Terms and Conditions, including any applied Terms shall not extend to any consequential loss whatsoever suffered by the client or their guests.
  • Dates and timings are subject to licensing approval.
  • It must be appreciated that labour, entertainment and certain food items must be booked and paid for in advance.
  • The Old Hall Christmas Events are restricted to persons aged 18 years or over. We operate a strict ‘Challenge 25’ scheme, therefore we reserve the right to request proof of age if any guest looks under 25 (ID accepted: valid passport or valid photograph driver license.)
